SAVY Buyer Disclosure

This is an agreement between you the Customer, Galpin Motors, Inc (hereinafter “Dealer”), and DEALER COMMUNICATIONS, LLC. Please read this agreement before using the SAVY product, website, or service. Keep a copy of this agreement and all future addenda or amendments to this agreement in a safe place. You are required to read and accept terms of all updated agreements provided by Dealer before continuing usage of the SAVY product, website, or service.

A SAVY Device, provided by Dealer, has been installed on your vehicle.

1. SAVY:

When the Device is connected, you can track and locate your vehicle from a mobile application. If you purchase the SAVY plan, this price will include the hardware device and a 36-month mobile app Service Access Package from date of purchase.

2. Your acceptance of or paying for SAVY is NOT a condition of your being able to buy the vehicle.

This is a separate agreement subject to the SAVY Terms and Conditions agreement.

3.DEVICE DATA COLLECTION

i. DEALER COMMUNICATIONS and Dealer collect information about your Device several different ways: information you provide to DEALER COMMUNICATIONS when you register the Device for use and from your Device itself when the Device is active. The information DEALER COMMUNICATIONS receives, accesses, collects, copies, maintains, and stores from your Device includes information such as data about its operation, about your use of the vehicle, and about the location of your vehicle while the device is connected to your vehicle. At any time, the device can be disconnected from the vehicle and no further data will be collected by the device for as long as it remains disconnected.

ii. You agree that DEALER COMMUNICATIONS and Dealer can, subject to applicable law, access, collect, use, copy, maintain, store, and distribute any of this information to: (a) provide DEALER COMMUNICATIONS services to a Third Party for your benefit (including sharing that information with roadside assistance providers, emergency service providers, law enforcement or others, as needed); (b) check or maintain your DEALER COMMUNICATIONS Equipment, including monitoring and recording of information for troubleshooting, training, and to maintain the quality of service; (c) provide information to the maker of your vehicle about the vehicle’s performance and to enable the maker of your vehicle to comply with law; (d) help you to maintain the vehicle; (e) evaluate and improve its service; (f) enforce this agreement with you or others; (g) prevent fraud or misuse of DEALER COMMUNICATIONS service; (h) comply with legal requirements of wireless carriers, valid court orders and exigent circumstances; (i) protect the rights, property, or safety of you or others; and (j) perform market research (k) provide information to your lender/finance company in accord with agreements with such entity, but only where in compliance with all applicable state and federal privacy laws. You further agree that the above uses do not constitute an invasion of your privacy, or that you waive any such right to privacy to the fullest extent allowed by law.

iii. Because DEALER COMMUNICATIONS and Dealer provide service through wireless networks, DEALER COMMUNICATIONS and Dealer cannot promise that your communications will not be intercepted by others or completely interrupted. You agree DEALER COMMUNICATIONS and Dealer will not be liable for any damages for any loss of privacy occurring in communication over such networks.

4. WIRELESS PRIVACY:

The airtime provider’s network has many complex elements and is not guaranteed against eavesdroppers, hackers, denial of service attacks, viruses, or interceptors. You agree that Dealer and DEALER COMMUNICATIONS shall not be liable to you for any lack of privacy or security related to the airtime provider’s network while the service is functioning if you OPT IN.

5. GOVERNING LAW:

To the fullest extent permitted by law and except as explicitly provided otherwise, this Agreement and any disputes arising out of or relating to it will be governed by the laws of the state governing the SAVY Reseller Agreement or SAVY Dealer Service Agreement (whichever is applicable) between your Dealer and DEALER COMMUNICATIONS, without regard to its conflict of law principles, and by any applicable tariffs, wherever filed.

6. The programs listed above are NOT assignable.

If you sell your vehicle prior to the expiration of one or both of these programs, you agree to immediately remove the device. If not, you agree these programs may then be permanently shut off and the remainder of the three years will immediately expire with no reimbursement to you. If you remove the device, you may connect it to a new vehicle for your own personal use and register that vehicle within the app.

7. The SAVY Device may require the use of the 3G cellular networks to transmit data collected by the device back to the servers to display on your mobile application access.

You agree that access to these networks is subject to 3G network availability and that maintaining 3G network infrastructure is outside the control of the DEALER or DEALER COMMUNICATIONS. You agree that in the event the 3G network access is unavailable, Dealer and DEALER COMMUNICATIONS shall not be liable to you for network access for any guaranteed amount of time and the remainder of the mobile app access period will remain available to you regardless of network connectivity status.

8. Replacement Device and Warranty:

Your hardware includes a limited warranty further explained in the Terms and conditions for a period of 90 days from the date of purchase. 9. Refunds for the Savy Program Access and/or Hardware Device are handled by the dealer who sold the package to you.

Dealer Communications is not liable for and does not process refunds. If you are seeking a refund, please contact the Dealer.
